Title Curative
Clear title is imperative for the swift disposal of REO assets or even just to have an insurable title. Immediately upon receipt of an order, Visionet begins curative work to achieve ‘insurable’ title so that the property is ready to refinance or market and sell as quickly as possible.
All title work is reviewed and graded by highly experienced professions from the industry. Curative resolution starts immediately by ascertaining the curative summary. Title curative procedures include, but are not limited to:
- Retrieving HUD-1 and mortgagee’s title policies
- Contacting prior closing agents to obtain information about any issues
- Consulting with foreclosure attorneys (if applicable) to determine the best course of action
- File review to determine insurability
- Monitoring title claims as needed
- Contacting prior lien holders to confirm lien status and secure releases
Curative Process
- Confirm vesting. This will consist of Trust issues, vesting issues such as the need to add or remove a party due to marriage or divorce or the need to establish the fact of death.
- Confirm address. This will consist of Confirm address. This will consist verifying the address from the recorded Deed of Trust, warranty Deed and Tax Certificate.
- Verifying if the there are any open mortgages on title and Request payoff if needed.
- If there is any lien that needs to be subordinated – Request for subordination requirements and agreement.
- Clearing of prior mortgages by contacting the loan servicer to determine the validity of the loan using various methods – phone calls, web-sites such as Lane Guide MERS.
- Clearing of judgments by contacting multiple sources as disclosed on the document. This process will include the use of on-line services such as Google, FindLaw.com etc…
- Child Support liens. This will consist of calling and confirming Socials, DOB, Addresses, and Middle Names. Submitting requests to various State and County Court systems to obtain child support information such as payoffs, releases and letters of arrears.
- IRS Liens: Contact Department of Internal Revenue Service and Request for Release or payoff.
- Obtain Current Tax Information.
- Prepare CPL.
- Prepare Prelim HUD.
- Review if the property has HOA if yes- Request for HOA docs and account Statement to check if there are any amount due and needs to be collected at closing.
